It’s important to be aware that a doctor who is not a licensed MMJ doctor cannot give you a certification for medical MMJ . You must speak with a health care practitioner who is licensed to practice and recommend medical MMJ treatment in the state of  New York.

Who is eligible?

To enrol in the program the patient must be eighteen (18) years or older. A patient younger than eighteen (18) years of age must have designated and registered an ‘Approved Caregiver’ on behalf of the patient.

The patient must be a resident in the state of New York, valid proof of residency can be either in the form of a state-issued ID card or a New York State Driver’s License.

If the patient does not have a valid state-issued ID card or Driver’s license, a U.S passport along with a document that serves as a proof of address such as a bank statement or utility bill might be accepted by the state.

What type of Documentation is required?

The patient must obtain an evaluation from a certified practitioner within the state, and be diagnosed with one or more of the ‘qualifying medical conditions’ listed above.

All patients are required to obtain legitimate health documentation or medical records outlining their specific diagnosis. The patient’s existing medical records should be transferred to the recommending certified practitioner prior to their first visit. This is to ensure that the process can proceed without delay.

The patient will need to obtain a written certification from a certified practitioner who is licensed to practice and recommend medical MMJ treatment in New York.

 

 

How do I submit an Application?

The patient must sign up for an account at my.ny.gov. When creating a new account select ‘Medical MMJ data management system’.

After the patient has received a medical MMJ recommendation, they must submit an online application to the New York Department of Health Patient Registry.

Designated caregivers must also register with the New York State Department of Health.

* All patients and designated caregiver must pay the application fee of $50.00.

* A patient can designate up to two (2) designated caregivers.

The patient must submit an application for a New York Medical MMJ card to the appropriate state authority in order to be approved for the New York state medical MMJ program.

Once the application process is complete, and the patient has been approved, a temporary Registry ID card will be issued to the patient through their my.ny.gov account. Approved Medical MMJ products can be purchased with your state-issued ID. The Medical MMJ ID card will be sent through the mail to the address listed in the application.

 

NY Medical MMJ Laws

The New York medical MMJ program was initiated in 2014 when Governor Cuomo gave patients and caregivers legal protection under the Compassionate Care Act.

We know that when it comes to medical MMJ , state law and federal law can become a little confusing. What is important to remember, is that despite the New York regulations, MMJ is still classified as a Schedule I drug by the federal government. Because of this, doctors cannot prescribe medical MMJ to their patients in the traditional way.

As a result, patients can’t go to a regular pharmacy to get their prescribed medical MMJ . Instead, since the Compassionate Care Act was signed, registered patients have been able to access medical MMJ at registered organizations, more commonly known as dispensaries. These organizations have been regulated and licensed by the New York state to cultivate MMJ in order to provide medical MMJ to patients.

In addition, all patient must follow the state guidelines for possession, use and cultivation.

How to get Medical MMJ in New York

Remember, you will need to have your medical MMJ card in order to buy products from dispensaries. If you don’t have one yet, you will need to first get a certification from a NY licensed medical MMJ doctor.

Then you can apply for registry ID (Medical MMJ card) with the NY Department of Health. Once you have a Medical MMJ ID Card, you will be able to buy medical MMJ products from a certified dispensary.

Only patients with a valid New York Medical MMJ Card from the Department of Health may have access to dispensaries. Once you have obtained your med card, you may purchase medical MMJ from a dispensary.

New York Caregiver information

Some patients are unable to visit a dispensary in person to purchase their medical MMJ. Should that be the case, you may want to designate one or two caregivers to assist you. The caregiver(s) will make sure you are able to obtain and correctly use the prescribed MMJ. If you wish to designate a caregiver, you must do so when you apply for your medical MMJ card. However, there are some specific requirements that a person must meet before they can become a caregiver.

  • The person must be 21 years of age
  • They must have a valid state-issued ID to prove NY residency.
  • Your medical MMJ doctor cannot be your designated caregiver.

When the New York Department of Health approves the patient’s application, their caregiver(s) must register with as well. Caregiver(s) will receive a registry ID so that they may visit a dispensary on behalf of their patient. You can find instructions for Caregiver Registration here.

How to renew your Medical MMJ card.

Patients

Please note – Your medical MMJ recommendation is only valid for 1 year. After that time, you will need to be re-evaluated by one of our licensed medical MMJ doctors. However, you don’t have to worry your license expiring. When it’s time to renew your license, we will reach out and remind you to schedule your next appointment.

Caregivers

Important – If you are a caregiver, your Registry ID is only valid for the same period as your patient’s medical MMJ card. When your patient’s card expires, they will need to get a new certification from their doctor. After your patient has successfully renewed their med card, you will need to renew your registry card as well. You need to make sure that you have a valid Registry ID card when buying from a dispensary.

Do I qualify with chronic pain for medical MMJ in New York?

Yes, chronic pain is one of the qualifying conditions in New York, and medical MMJ is sometimes used to treat patients with chronic pain living in NY. However, you should be aware that patients suffering from chronic pain will need to provide additional information when booking a consultation. You will be asked to give a copy of a letter from your physician that states you have unsuccessfully tried other treatment methods which have not worked such as prescription drugs or surgery. Your medical diagnosis must show that you have been suffering from your condition for 3 months or anticipate that it will last more than 3 months from when you were diagnosed.

Can you get medical weed for anxiety & depression in New York?

No, unfortunately, anxiety and depression has not been recognized as qualifying conditions in the state of New York yet. If you have anxiety or depression in addition to one of the other qualifying conditions (NY) you should consult with a medical MMJ doctor about treatment.

No. Having one or more of the qualifying condition does not guarantee that you’ll get approved for a med card. It is still up to the healthcare provider to evaluate whether you’re likely to benefit from MMJ treatment.

How does the video consultation work?

Once you have registered and confirmed the time of your medical MMJ appointment, the consultation will be done through a secured and encrypted video call. It typically lasts for 10-15 minutes.

How much does it cost to get certified for a med card?

It’s $139 for the doctor’s consultation and the certification that they will submit to the state. 

What are my next steps once I’m approved by the provider?

Once approved, you will need to register with the state’s Medical MMJ program. You can find comprehensive instructions on the registration process by visiting Patients Information.

What happens if the provider rejects me?

In the rare instance that the provider believes that medical MMJ will not be suitable for your condition, we will waive your consultation fee and refund your payment. 

How long after the consultation do I get my med card?

After the video call consultation, if you are approved by the provider, you will receive your medical MMJ certification soon after. You will use this certification to complete your registration with the New York Medical MMJ Program Patient Registry.

After your registration is approved, you will be issued a Temporary Registry Identification Card, which may be used together with a government-issued photo identification until you receive your registry identification card in the mail. Please allow approximately seven business days to receive your Patient or Caregiver Registry ID Card.

What if I don’t have a New York State Driver’s License?

You may submit one or more of the following documents as proof of your residency: 

  • Lease or property document
  • Utility bill showing your name and New York address, issued within the last 60 days
  • A government-issued ID card that shows your New York State address.
  • For temporary residents who are receiving treatment for a qualifying medical condition, you may show residency by providing a hospital bill or other documentation as approved by the Department of Health.

How long is my med card valid for?

New York MMJ cards are valid for one year from the date of issue.  If you plan to renew your card, you will need to consult with a healthcare provider again. The healthcare provider will evaluate if you are still eligible to use medical MMJ. This should be done at least 30 days before the card’s expiration date.

You can renew your certification by simply setting up another consultation with one of our providers. 

Can I use a medical MMJ card issued from another state to buy medical MMJ in New York?

No. New York does not accept out-of-state medical MMJ cards.
