Who qualifies for medical marijuana in Oklahoma?

Unlike many other states with a Medical Marijuana Program, there isn’t a strict list of ‘Qualifying Conditions’ in the state of Oklahoma. Instead, it is up to a certified medical marijuana doctor to evaluate if the use of medical marijuana would benefit their patient’s health. The doctor will make their judgement on the same basis as they would with regular prescriptions, and write their recommendation accordingly. It is up to your doctor to evaluate whether medical marijuana is appropriate for your illness or condition. The law state that: 

A medical marijuana license must be recommended according to the accepted standards a reasonable and prudent physician would follow when recommending or approving any medication.”

Medical cannabis is normally prescribed to patients if their doctor finds that they are suffering from a chronic illness or a debilitating medical condition and that they are not responding to traditional treatments. It’s important to be aware that a regular doctor who is not a licensed marijuana doctor cannot give you a certification for medical marijuana. You must speak with a health care practitioner who is licensed to practice and recommend medical marijuana treatment in your state. Can I get medical marijuana in Oklahoma?


To apply you must be eighteen (18) years or older. 

You also have to be a resident in the state of Oklahoma with a valid proof of residency. This is usually provided in the form of a state-issued ID card or a State Driver’s License.

If you don’t have a valid state-issued ID card or Driver’s license, a U.S passport along with a document that serves as a proof of address such as a bank statement or utility bill might be accepted by the state.

You must have a recommendation from a certified marijuana physician before you start your medical marijuana Oklahoma license application.

What type of Documentation is required?

When you submit the Adult Patient Application, you will be asked to provide the following information:

  • A clear, color, full-face digital photograph
  • Your Physician Recommendation dated within 30 days of application submission.
  • Proof of residency in Oklahoma (digital, color copy of one of the following):
    • Oklahoma driver’s license
    • Oklahoma identification card
    • Oklahoma voter identification card
    • A utility bill for the calendar month preceding the date of application, excluding cellular telephone and internet bills
    • A residential property deed to a property in the State of Oklahoma
    • A current rental agreement for residential property located in the State of Oklahoma
  • Proof of identity (digital, color copy of one of the following):
    • Oklahoma driver’s license 
    • Oklahoma identification card 
    • U.S. passport or other photo identification issued by the U.S government
  • Tribal identification card approved for identification purposes by the Oklahoma Department of Public Safety.

How do I submit my Application?

After the patient has received a recommendation from their physician, they can register as a patient at the Oklahoma Medical Marijuana Authority (OMMA). All patient applications must be submitted online. You can submit your application with the Patient Registry at the OMMA login page:

All patients must pay the $100 application fee 

* You may be eligible to pay a reduced fee of $20 if you are enrolled in Medicare (Soonercare) and can provide proof of enrollment.

If your application is approved, your Medical Marijuana Card (Patient License) will be mailed within fourteen (14) days. The Medical Marijuana Card will be mailed to your address as listed in your application. Once you have received your Medical Marijuana Card, you will be able to obtain, use and cultivate Medical Marijuana products legally within the state of Oklahoma.

When was medical marijuana legalized in Oklahoma?

The Oklahoma medical marijuana bill was passed in 2018 and it has benefitted hundreds of thousands of patients since. More than half of the participants voted on the ballot to legalize medical marijuana in the state, making it legal for approved patients to use the substance. 

The Oklahoma Department of Health now has an extensive medical cannabis program which is governed by the state program Oklahoma Medical Marijuana Authority (OMMA). Together, these entities make up the program responsible for the regulations and rules for the use and cultivation of medical cannabis in the state. 

We know that when it comes to medical marijuana, state law and federal law can become a little confusing. What is important to remember, is that despite the regulations in Oklahoma , Marijuana is still classified as a Schedule I drug by the federal government. Because of this, doctors cannot prescribe medical marijuana to their patients in the traditional way.

As a result, patients can’t go to a regular pharmacy to get their prescribed medical marijuana. Instead, registered patients have been able to access medical marijuana at registered organizations, more commonly known as dispensaries. These organizations have been regulated and licensed by the OMMA to cultivate cannabis in order to provide medical marijuana to patients.

In addition, all patient must follow the state guidelines for possession, use and cultivation.

How to apply for Oklahoma medical marijuana?

Some patients may have difficulties accessing dispensaries for various reasons, making it hard to get marijuana products for their ailment. In that event, these patients can discuss the option of designating a caregiver with their physician. 

A caregiver must meet the same criteria for age and residency status as registered patients.

How to renew your Medical Marijuana card.

Patients

Please note – Your medical marijuana recommendation is valid for 2 year. However, you will need to be re-evaluated by one of our licensed medical marijuana doctors after that time.

 

Caregivers

Important – If you are a caregiver, your Registry ID is only valid for the same period as your patient’s medical marijuana card. When your patient’s card expires, they will need to get a new certification from their doctor. After your patient has successfully renewed their med card, you will need to renew your registry card as well. You need to make sure that you have a valid Registry ID card when buying from a dispensary.
